Legitimacy of Armed Struggle Against India

Kashmiris have been struggling for their basic human rights and freedom from the tyrants for over ninety years. Their struggle has passed through different phases: pre partition, post partition, post Burhan Wani and Post 5th August 2019. Their generations have witnessed and gone through countless unforgettable events of massacres, rapes, and tortures. The history of unmatched struggle for freedom has never witnessed a single moment when Kashmiris gave up their struggle and bowed down to Indian barbaric forces. They lost their sons, their daughters & mothers got raped by Indian inhuman forces, women lost their husbands and children lost their parents, but they never gave up. The latest phase of the freedom struggle particularly the armed struggle started after the martyrdom of Burhan Wani at the hands of Indian forces on 8th July 2016.

The struggle of Kashmiris is based on the right to self-determination as per the UN Resolutions on disputed territory of Jammu and Kashmir, and the Universal Declaration of Human Rights. Though, the global powers especially the Western powers are going through moral crisis, but the United Nations still considers that the territory of state of Jammu and Kashmir is a disputed territory, and the right to self-determination is basic and legitimate right of Kashmiris which is yet to be provided. The abrogation of Article 370 has further given the legitimacy to the armed struggle against the Indian illegal occupation, as any struggle against the illegal and inhuman occupation is legitimate and under international law. Legally and morally, the international community must support the Kashmiris. The UN should impose economic sanctions on India for killing thousands of unarmed civilians in Kashmir. International Criminal Court (ICC) should be approached to hold Indian government accountable for committing gross human rights violations in Indian Illegally Occupied Jammu and Kashmir.
